The applicant claims that the Court should:

order the defendant, representing the European Anti-Fraud Office (OLAF), to pay the applicant the sum of EUR 7 000 000 by way of compensation for non-material damage;

order the defendant to pay the costs.

Pleas in law and main arguments

In support of the action, the applicant relies on three pleas in law.

1.First plea in law, alleging that during the investigation, OLAF incorrectly assessed the evidence, with the result that it wrongly decided to close the investigation into the project ‘Drinking water supply and connection to the sewage system in Horné Kysuce’ (Project No CCI 2004 SK 16 C PE 001), without opposing the adoption of the measure.

2.Second plea in law, alleging the manifest failure to state reasons for the notice of closure of the enquiry and the uncontrollable nature of that notice.

3.Third plea in law, alleging inaction by OLAF after the second complaint was lodged on 8 June 2018 and failure to open a new investigation.
