Opinion of the Advocate-General

Mr Advocate General Jacobs delivered his Opinion on 19 April 1989 . (*) He considered that the Court should declare that, by laying down a requirement of affiliation to a national inspection agency for the importing, exporting and offering for export of propagating material for agricultural plants, for vegetables and spices, and for fruit trees and certain other trees, the Kingdom of the Netherlands had failed to fulfil its obligations under Regulations Nos 234/68 and 2358/71 and, in respect of seed potatoes, under Articles 30 and 34 of the EEC Treaty; the Netherlands should be ordered to pay the costs .
