The Court:

1.Dismisses the action;

2.Orders Électricité de France (EDF) to bear its own costs and to pay the costs incurred by the European Commission, with the exception of those incurred by the latter as a result of the intervention of the French Republic;

3.Orders the French Republic to bear its own costs and to pay those incurred by the Commission as a result of its intervention.
