The applicant claims that the Court should:

declare that, by failing to adopt the legislative, regulatory and administrative provisions necessary to comply with Commission Directive 2009/113/EC (1) of 25 August 2009 amending Directive 2006/126/EC of the European Parliament and of the Council on driving licences, or, in any event, by failing to inform the Commission of such provisions, the Portuguese Republic has failed to fulfil its obligations under Article 2(1) of that directive;

order the Portuguese Republic to pay the costs.

Pleas in law and main arguments

The time-limit for transposing the directive expired on 14 September 2010.
