The Commission claims that the Court should:
—declare that, by maintaining the provisions laid down in Article 2 of the KB/WIB 92 concerning the exemption of income from savings deposits and, therefore, by limiting access to the Belgian banking market by service providers established in other EU and EEA Member States, the Kingdom of Belgium has failed to fulfil its obligations under Article 56 TFEU and Article 36 of the EEA Agreement;
—order the Kingdom of Belgium to pay the costs.
The Commission submits that the Kingdom of Belgium has failed to fulfil its obligations under Article 56 TFEU and Article 36 of the EEA Agreement by maintaining a tax exemption scheme in respect of savings deposits, in so far as, while it applies without distinction to income from savings deposits held with banking service providers established in Belgium and in another EU or EEA Member States, it makes access to the Belgian banking market by service providers established in other Member States subject to conditions which are specific to the national market alone.
