Re:

ACTION for annulment in its entirety or, in the alternative, in part, of Directive 2004/52/EC of the European Parliament and the Council of 29 April 2004 on the interoperability of electronic road toll systems in the Community (OJ 2004 L 166, p. 124, corrigendum OJ 2004 L 200, p. 50).

Operative part

The Court:

1.Dismisses the action as inadmissible;

2.Orders Efkon AG to bear its own costs and pay those of the Council;

3.Orders the Parliament and the Commission to bear their own costs.
