On 23 November 2022, the Commission received a notification of a proposed concentration pursuant to Article 3(1)(b) of Council Regulation (EC) 139/2004 by which certain funds managed and advised by AIC, a globally active advisor to and manager of private equity investment funds, intend to acquire sole control over (i) HPM of LANXESS and (ii) DEM of DSM.
The business activities of the undertakings concerned are:
(a) HPM: the manufacture, sale and marketing of thermoplastic polymers and intermediates necessary for the production of such polymers, i.e. PA-based engineering plastics, PBT-based engineering plastics, and continuous fibre-reinforced thermoplastic composites.
(b) DEM: the development, production and supply of high-performance thermoplastics, offering a broad range of polymers, incl. PAs, polyesters and polyphenylene sulphides to a wide range of industries.
(c) Advent is a private equity investor based in Boston, USA. Advent focuses on (i) the acquisition of equity stakes (both controlling and non-controlling) in companies where it believes that an injection of capital would improve the company’s future prospects for growth, and (ii) the management of investment funds. As a private equity investor, Advent has holdings in various sectors, including industrial, technology, retail, consumer and leisure, healthcare, and business and financial services.
