declare the current application admissible and well-founded ;

annul the decision of the European Union Agency for the Operational Management of Large-Scale IT Systems in the Area of Freedom, Security and Justice (eu-LISA) to issue a call for tenders no 361026-2024 ;

order the Defendant to pay the costs.

Plea in law and main arguments

In support of the action, the applicants rely on one plea in law, alleging that:

the main arguments and pleas in law of the applicants can be deduced from the line of argumentation concerning legal standing and legal interest. Namely that by initiating the Second Tender, by which the framework agreement will be concluded, it would be a parallel and identical or overlapping framework agreement to the framework agreement already signed in the context of the First Tender. By that virtue, the legitimate expectations and rights for equal treatment of the applicants would be infringed if the defendant would be allowed to enter into a parallel framework agreement which in turn would be used for call-off contracts.
