By their action under Article 263 TFEU, the applicants seek the annulment of the decision contained in the European Commission’s letter received on 24 October 2023, by which the Commission rejected their request, made by letter of 28 August 2023, to review, in light of the new situation that has arisen in the European Union with the disappearance of Bovine Spongiform Encephalopathy (BSE), the current prohibition on the use of blood and blood products of bovine origin in the diet of aquaculture animals and to present draft measures allowing their use.
Operative part of the order
1.The action is dismissed as inadmissible.
2.Apc Europe SL and the other applicants whose names are included in the annex shall, in addition to bearing their own costs, pay those incurred by the European Commission.
