Declare that, by failing to adopt the laws, regulations and administrative provisions necessary to comply with Directive 2006/121/EC (1) of the European Parliament and of the Council of 18 December 2006 amending Council Directive 67/548/EEC on the approximation of laws, regulations and administrative provisions relating to the classification, packaging and labelling of dangerous substances in order to adapt it to Regulation (EC) No 1907/2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) and establishing a European Chemicals Agency or, in any event, by failing to communicate those measures to the Commission, the Portuguese Republic has failed to fulfil its obligations under Article 2 of Directive 2006/121/EC.

Order the Portuguese Republic to pay the costs.

Pleas in law and main arguments

The period prescribed for transposing the directive expired on 1 June 2008.
