The appellant claims that the Court should:

set aside the judgment delivered by the First Chamber of the General Court of the European Union on 29 January 2025 in Case T-1106/23;

declare the appeal to be admissible and well-founded;

declare that Decision (CFSP) 2023/1094 of 5 June 2023 amending Decision 2014/145/CFSP (1) does not apply to Mr Alexander Vinokurov because criterion (g) as amended is unlawful;

declare that Regulation (EU) 2023/1089 of 5 June 2023 amending Regulation (EU) No 269/2014 (2) does not apply to Mr Alexander Vinokurov because criterion (g) as amended is unlawful;

annul Council Decision (CFSP) 2023/1767 of 13 September 2023 amending Decision 2014/145/CFSP concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine, (3) in so far as it concerns Mr Alexander Vinokurov;

annul Council Implementing Regulation (EU) 2023/1765 of 13 September 2023 implementing Regulation (EU) No 269/2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine, (4) in so far as it concerns Mr Alexander Vinokurov;

annul Council Decision (CFSP) 2024/847 of 12 March 2024 amending Decision 2014/145/CFSP concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine, (5) in so far as it concerns Mr Alexander Vinokurov;

annul Council Implementing Regulation (EU) 2024/849 of 12 March 2024 implementing Regulation (EU) No 269/2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine, (6) in so far as it concerns Mr Alexander Vinokurov;

order the Council to pay all the costs and expenses of the proceedings.

Grounds of appeal and main arguments

In support of his action, the appellant puts forward five grounds of appeal.

first ground, alleging that the third part of criterion (g) as amended is unlawful on account of breach of the principles of legal certainty and proportionality;

second ground, alleging that the first part of criterion (g) as amended is unlawful on account of breach of the principles of legal certainty and proportionality;

third ground, alleging error of assessment;

fourth ground, alleging breach of the principle of proportionality and disproportionate interference with fundamental rights;

fifth plea, alleging breach of the principle of legal certainty.
