The Court:
1.Dismisses the action;
2.Orders H&R ChemPharm GmbH to bear its own costs and those incurred by the European Commission;
3.Orders H&R ChemPharm GmbH to refund the General Court the sum of EUR 10 000 under Article 90(a) of its Rules of Procedure.
