The appellant claims that the Court should:
—set aside the judgment under appeal and declare the action brought by the applicant in Case T-569/23 well founded and, consequently;
—annul the decision contested at first instance; or, if that is not possible,
—refer the case back to the General Court for judgment; and
—order the European Commission to pay all the costs.
Grounds of appeal and main arguments
In support of his appeal, the appellant raises two grounds of appeal, alleging, first, that the General Court erred in law and distorted the evidence offered in rejecting the first and fourth pleas raised at first instance and, second, that the General Court distorted an element of the file, was inconsistent in its reasoning, infringed the rights of the defence and made an error of law in rejecting the third plea raised at first instance.
