By her action under Article 270 TFEU, the applicant seeks compensation, first, for the material damage she claims to have suffered as a result the European Commission’s decision of 24 February 2023 refusing her request of 24 October 2022 for the reinstatement, ex-gratia, of a survivor’s pension and, second, for the non-material damage she claims to have suffered as a result of the improper handling of her request of 24 October 2022.

Operative part of the order

The action is dismissed as in part inadmissible and in part manifestly lacking any foundation in law.

There is no need to rule on the application to intervene made by the International Association of Former Officials of the European Union (AIACE).

BT shall pay the costs.
