By his action under Article 270 TFEU, the applicant seeks, first, annulment of the decision of 28 February 2023 by which the selection board for competition EPSO/AD/383/21 decided not to include him on the reserve list for the competition and, second, compensation for the damage which he claims to have suffered as a result of the failure to include his name on the reserve list for the competition.

Operative part of the judgment

The Court:

1.Dismisses the action;

2.Orders Mr Yavor Markov and the European Commission to bear their own costs.
