The applicant claims that the Court should:
—annul Council Decision (CFSP) 2023/1767 of 13 September 2023 amending Decision 2014/145/CFSP concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine, (1) as published in the Official Journal of the European Union on 14 September 2023;
—annul Council Implementing Regulation (EU) 2023/1765 of 13 September 2023 implementing Regulation (EU) No 269/2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine, (2) as published in the Official Journal of the European Union on 14 September 2023, collectively referred to as the ‘Contested Acts’, insofar as the Contested Acts maintain the applicant in the list of persons and entities subject to the restrictive measures;
—order the Council to bear the costs of the present proceedings.
In support of the action, the applicant relies on five pleas in law.
1.First plea in law, alleging distortion of evidence and of the relevant facts — lack of reliability, specificity and probative value of the evidence relied upon by the Council.
2.Second plea in law, alleging manifest error of assessment of the relevant facts and evidence — plea of illegality under Article 277 TFEU of the listing new criterion set out in Article 1(1)(e) and Article 2(1)(g) of Council Decision 2014/145/CFSP, (3) and Article 3(1)(g) of Council Regulation 269/2014, (4) introduced by Council Decision (CFSP) 2023/1094 (5) and Council Regulation (EU) 2023/1089 of 5 June 2023. 3.Third plea in law, alleging violation of the principles of equal treatment and non-discrimination.
4.Fourth plea in law, alleging violation of the principle of proportionality.
5.Fifth plea in law, alleging violation of fundamental human rights and freedoms.
