Re:

ACTION for the annulment of Directive 2003/33/EC of the European Parliament and of the Council of 26 May 2003 on the approximation of the laws, regulations and administrative provisions of the Member States relating to the advertising and sponsorship of tobacco products (OJ 2003 L 152, p. 16), in particular Article 5(1) thereof.

Operative part

The Court:

1.Dismisses the action as inadmissible;

2.Orders the applicant to bear its own costs, as well as those of the Parliament and the Council;

3.Orders the Kingdom of Spain, the Republic of Finland and the Commission, as well as Hockenheim-Ring GmbH and Exploitatie Circuit Park Zandvoort BV, to bear their own costs.
