1)Must Article 5(3) of Council Regulation (EC) No 44/2001 of 22 December 2000 (1) be interpreted as meaning that an action for damages for the abrupt termination of an established business relationship for the supply of goods over several years to a retailer without a framework contract, nor an exclusivity agreement is a matter relating to tort?

2)If the answer to the first question is in the negative, is Article 5(1)(b) of that regulation applicable in determining the place of performance of the obligation at issue in Question 1?
