By its action under Article 263 TFEU, the applicant seeks, in essence, the annulment of the decision of the European Monitoring Centre for Drugs and Drug Addiction (EMCDDA) of 2 October 2023 awarding the public contract following the tender procedure FC.23.EXO.0010.2.0 ‘Coordination and provision of interpreting services to the EMCDDA’ (lots 1 and 2) to another tenderer and, consequently, either the exclusion of the tender ranked first and the award of the contract to the applicant, or a declaration that the EMCDDA is required to provide the applicant with the information and evidence which it has sought.

Operative part of the judgment

The Court:

1.Annuls the decision of the European Monitoring Centre for Drugs and Drug Addiction (EMCDDA) of 2 October 2023 awarding the public contract following the tender procedure FC.23.EXO.0010.2.0 ‘Coordination and provision of interpreting services to the EMCDDA’ (lots 1 and 2) to another tenderer;

2.The action is dismissed as to the remainder;

3.Orders the European Union Drugs Agency (EUDA) to pay the costs.
