The applicant claims that the Court should:

declare, in accordance with Articles 263 and 264 TFEU, the partial annulment of Council Decision (CFSP) 2023/1767 (1) of 13 September 2023 and Council Implementing Regulation (EU) 2023/1765 (2) of 13 September 2023 as regards the following reference in the summary of ‘Reasons’ in paragraph 923 of Annex I concerning the sanction against Ms Anastasia IGNATOVA: ‘Anastasia Ignatova formally owned the 85-metre yacht “Valerie” worth USD 140 million (more than RUB 10 billion) through a British Virgin Islands company called Delima Services Limited’, by deleting and rendering that reference null and void;

order the Council of the European Union to pay the costs.

Pleas in law and main arguments

In support of the action, the applicant relies on four pleas in law.

1.First plea in law, alleging infringement of Article 14 of Regulation (EU) No 269/2014 (3) and Article 6(3) of Decision 2014/145/CFSP (4) concerning sanctions against Russia in relation to Ukraine, and of the principles of legal certainty, legality and sound administration without misuse of powers.

2.Second plea in law, alleging breach of the principle of legality in relation to sanctions in the field of common foreign and security policy.

3.Third plea in law, alleging infringement of the right to equality before the law.

4.Fourth plea in law, alleging infringement of the right to property.
