By their action based on Article 263 TFEU, the applicants seek annulment of the decision of the President of the European Parliament allegedly contained in his letter of 10 December 2019, sent in response to the request that the Parliament, on the basis of Rule 9 of its Rules of Procedure, defend their parliamentary immunity.

Operative part of the judgment

The Court:

1.Dismisses the action;

2.Orders Mr Carles Puigdemont i Casamajó and Mr Antoni Comín i Oliveres to bear their own costs and to pay those incurred by the European Parliament;

3.Orders the Kingdom of Spain to bear its own costs.
