(Amicable settlement on the initiative of the Tribunal – Removal from the register)

Application: brought under Articles 236 EC and 152 EA, in which Mr Locchi essentially seeks annulment of the Commission’s decision of 15 February 2008 to exclude him from the final list of officials pre-selected for the certification procedure 2007 and, consequently, still relating to the certification procedure 2007, from the list of candidates pre-selected with the best marks and from the list of applicants admitted to the training programme, as well as annulment of the Commission’s decision of 20 November 2007 concerning the general provisions implementing Article 45a of the Staff Regulations.

Held: Case F‑78/08 Locchi v Commission is removed from the register of the Tribunal. The Commission is to pay the fixed sum of EUR 4 000 to the applicant, who in return waives all claims, including in relation to costs.
