The applicant claims that the Court should:

annul the decision adopted on 21 June 2024 by the European Peace Facility Committee on the allocation of amounts to assistance measures for the supply of military support to the Ukrainian Armed Forces, subject to the conditions laid down in Council Decision (CFSP) 2024/1471 of 21 May 2024, (1) and annul in part the minutes of the meeting of the European Peace Facility Committee of 25 June 2024 recording the adoption of the decision of 21 June 2024;

order the Council of the European Union and the European Peace Facility Committee to pay the costs.

Pleas in law and main arguments

In support of its action, the applicant puts forward one plea in law, alleging infringement of Article 31(1) TEU and of Council Decision (CFSP) 2021/509, in conjunction with the vote taken in the European Peace Facility Committee. (2)

The European Peace Facility Committee infringed the abovementioned provisions when it adopted the contested decision, as it took the view that Hungary was not entitled to participate in the vote because, allegedly, it was not a ‘contributing Member State’, as a result of which its vote was disregarded. That infringed the principle of equality between Member States and the principle of the democratic functioning of the European Union, since a Member State was deprived, without any legal basis and in an improper fashion, of its right to vote.
