The appellant claims that the Court should:

set aside the judgment under appeal;

dispose of the actions on the merits and annul the contested acts, Council Decision (CFSP) 2023/421 (1) of 24 February 2023 and of Council Implementing Regulation (EU) 2023/419 (2) of 24 February 2023, Council Decision (CFSP) 2024/769 (3) of 26 February 2024 and Council Implementing Regulation (EU) 2024/768 (4) of 26 February 2024, insofar as those measures (together, the ‘Contested Measures’) apply to the appellant; or

in the alternative, remit the case to the General Court.

Pleas in law and main arguments

In support of its appeal, the Appellant relies on two grounds of appeal:

First, that the General Court erred in law by concluding that the Application was inadmissible; and

Second, that the General Court erred in law by concluding that the Contested Measures were not vitiated by errors of assessment.

(1) Council Decision (CFSP) 2023/421 of 24 February 2023 amending Decision 2012/642/CFSP concerning restrictive measures in view of the situation in Belarus and the involvement of Belarus in the Russian aggression against Ukraine (OJ 2023, L 61, p. 41).

(2) Council Implementing Regulation (EU) 2023/419 of 24 February 2023 implementing Article 8a of Regulation (EC) No 765/2006 concerning restrictive measures in view of the situation in Belarus and the involvement of Belarus in the Russian aggression against Ukraine (OJ 2023, L 61, p. 20).

(3) Council Decision (CFSP) 2024/769 of 26 February 2024 amending Decision 2012/642/CFSP concerning restrictive measures in view of the situation in Belarus and the involvement of Belarus in the Russian aggression against Ukraine (OJ L, 2024/769).

(4) Council Implementing Regulation (EU) 2024/768 of 26 February 2024 implementing Article 8a of Regulation (EC) No 765/2006 concerning restrictive measures in view of the situation in Belarus and the involvement of Belarus in the Russian aggression against Ukraine (OJ L, 2024/768).
