declare that, by not adopting all the laws, regulations and administrative provisions necessary to comply with Directive 2005/29/EC, or, in any event, by not communicating those provisions to the Commission, the Federal Republic of Germany has failed to fulfil its obligations under Community law, in particular under Article 19 of that directive;

order the Federal Republic of Germany to pay the costs.
