The applicant claims that the Court should:
—annul the Commission’s decision, set out in a letter of 6 August 2024, by which the Commission rejected a request for internal review brought by the applicant pursuant to Article 10 of the Aarhus Regulation (1);
—order the defendant to pay the costs;
—order any other measure deemed appropriate.
In support of the action, the applicant relies on three pleas in law.
1.First plea in law, alleging that the defendant erred in law in claiming that the Contested Act is not imputable to the defendant and is therefore not an act adopted by it for the purpose of Article 10(1) of the Aarhus Regulation.
2.Second plea in law, alleging that the defendant erred in law in claiming that the Contested Act did not produce legal and external effects.
3.Third plea in law, alleging that the defendant erred in law when it did not consider the applicant’s request for internal review on the merits. Under Article 10(2) of the Aarhus Regulation.
