The applicants claim that the Court should:

annul, in whole or in part, the decision adopted by the European Chemicals Agency on 4 March 2025 in Case ATD/009/2025 regarding an application for access to documents and;

order the European Chemicals Agency to pay the costs.

Pleas in law and main arguments

In support of the action, the applicants rely on two pleas in law.

1.First plea in law, alleging that the defendant erred in the interpretation and application of Article 6(1) and 6(2) of Regulation (EC) No 1367/2006 (1).

2.Second plea in law, alleging that the defendant erred in the interpretation and application of Article 4(2) of Regulation (EC) No 1049/2001 (2) in conjunction with Article 6(1) and 6(2) of Regulation (EC) No 1367/2006.
