By its application based on Article 263 TFEU, the applicant seeks the annulment, first, of Commission Decision Ares(2024) 1081885 of 13 February 2024, rejecting the applicant’s tender in procurement procedure NEAR/TBS/2023/EA-RP/0125 concerning technical services provided in support of the EU-Georgia bilateral agreements and, second, all the measures taken or to be taken in the context of that procedure, in particular the tender evaluation reports, the award decision and any contract entered into with the successful tenderer.

Operative part of the order

1.There is no longer any need to adjudicate on the action.

2.The European Commission shall pay the costs, including those relating to the proceedings for interim measures.
