By its action under Article 263 TFEU, the applicant seeks the annulment of the European Commission’s decision of 21 January 2022, by which the latter rejected the tender the applicant had submitted under the call for tenders DIGIT/A3/PR/2019/010 relating to Trans-European Services for Telematics between Administrations (TESTA) and awarded the contract to the intervener, BT Global Services Belgium

1.There is no longer any need to adjudicate on the action.

2.The European Commission shall bear its own costs and pay those incurred by Telefónica de España, SA in the present case and in Cases T-170/22 R, C-478/22 P(R), C-478/22 P(R)-R and T-170/22 R-RENV.

3.BT Global Services Belgium shall bear its own costs in the present case and in Cases T-170/22 R, C-478/22 P(R), C-478/22 P(R)-R and T-170/22 R-RENV.
