By its action under Article 265 TFEU, the applicant asks the Court to declare that the European Commission unlawfully failed to act in Case SA.33828 relating to the Greek tonnage tax scheme, by failing to adopt a decision to initiate a formal State aid investigation procedure or by failing to take a position on whether or not the appropriate measures which it had sent to the Hellenic Republic on 18 December 2015 and which were not accepted by the latter continued to be necessary.
1.There is no longer any need to adjudicate on the action.
2.Federation of European Private Port Operators (Feport) shall bear half of its own costs.
3.The European Commission shall bear its own costs and shall pay half of those incurred by Feport.
4.The Hellenic Republic shall bear its own costs.
