Re:

Appeal brought against the judgment of the European Union Civil Service Tribunal (Second Chamber) of 11 July 2013, in AN v Commission (F-111/10, ECR — Staff Cases, EU:F:2013:114) and seeking annulment of that judgment.

Operative part of the judgment

The Court:

1.Sets aside the judgment of the European Union Civil Service Tribunal (Second Chamber), in AN v Commission (F 111/10, ECR — Staff Cases, EU:F:2013:114), in so far as it failed to adjudicate on the plea in law alleging the irregularity of the investigation with the reference CMS 07/041;

2.Dismisses the appeal as to the remainder;

3.Rejects the action brought by AN before the Civil Service Tribunal in in Case F-111/10;

4.Orders AN to bear her own costs and to pay half of the costs incurred by the European Commission relating both to the proceedings before the Civil Service Tribunal and the present proceedings;

5.Orders the Commission to bear half of its own costs relating both to the proceedings before the Civil Service Tribunal and the present proceedings.
