By its action under Article 263 TFEU, the applicant seeks the annulment of the decision of the Board of Appeal of the European Union Agency for the Cooperation of Energy Regulators (ACER) of 28 May 2021, confirming ACER Decision No 33/2020 of 4 December 2020 on the proposal of the electricity transmission system operators of the ‘Core’ capacity calculation region, comprising Belgium, the Czech Republic, Germany, France, Croatia, Luxembourg, Hungary, the Netherlands, Austria, Poland, Romania, Slovenia and Slovakia, for the common methodology for regional operational security coordination, and dismissing the applicant’s appeal in Case A-007-2021 (consolidated).
Operative part of the judgment
The Court:
1.Dismisses the action;
2.Orders Polskie sieci elektroenergetyczne S.A. to bear its own costs and to pay those incurred by the European Union Agency for the Cooperation of Energy Regulators (ACER);
3.Orders the Republic of Poland to bear its own costs.
