By its action under Article 263 TFEU, the applicant seeks annulment of the European Parliament’s resolution of 26 November 2020 on the de facto prohibition of the right to abortion in Poland [2020/2876(RSP)].

Operative part of the order

1.The action is dismissed as inadmissible;

2.Fundacja Instytut na rzecz Kultury Prawnej Ordo Iuris shall bear its own costs and pay those of the European Parliament in relation to the present proceedings and the proceedings in Cases T-42/21 and C-546/21 P.

Case referred back to the General Court by the Court of Justice following appeal (OJ C 261, 24.7.2023).
