The applicant claims that the Court should:

annul the defendant’s decision of 25 June 2024 insofar as it confirms the applicant’s appraisal report for the year 2023;

annul, if necessary the defendant’s decision of 14 January 2025 insofar as it rejects the applicant’s complaint of 24 September 2024;

order the defendant to compensate the moral prejudice suffered by the applicant which can be evaluated, ex aequo et bono, at 30 000 Euros;

order the defendant to pay all the costs.

Pleas in law and main arguments

In support of the action, the applicant relies on the following pleas in law.

1.First plea in law, alleging a breach of the right to be heard and a breach of Article 7(2) of the Management Board decision No 46/2015 of 20 November 2015 laying down general provisions for implementing Article 43 of the Staff Regulations and implementing the first paragraph of Article 44 of the Staff Regulations for temporary staff.

2.Second plea in law, alleging manifest errors of assessment.

3.Third plea in law, alleging a misuse of power, a breach of the principle of impartiality and a breach of Article 22a of the Staff Regulations.
