By his action based on Article 268 TFEU and the second paragraph of Article 340 TFEU, the applicant seeks compensation for the damage which he claims to have suffered as a result of the European Commission’s alleged unlawful conduct, on account of the Commission’s intervention as amicus curiae in proceedings between Mr Kargins and a third company before the Augstākā tiesa (Supreme Court, Latvia).

Operative part of the judgment

The Court:

Dismisses the action;

Orders Mr Rems Kargins to bear his own costs and to pay those incurred by the European Commission;

Orders the Council of the European Union to bear its own costs.
