Declare that, by failing to adopt the laws, regulations and administrative provisions necessary to comply with Directive 2004/48/EC of the European Parliament and of the Council of 29 April 2004 on the enforcement of intellectual property rights, or in any event by not communicating such measures to the Commission, the Republic of Portugal has failed to fulfil its obligations under that directive;

order the Republic of Portugal to pay the costs.

The period prescribed for transposing the Directive into national law expired on 29 April 2004.
