Re:

Application, first, under Article 263 TFEU seeking annulment of the Commission’s decision of 30 June 2020 rejecting the tender submitted by the applicant in the context of the call for tenders OIB/2019/CPN/039 concerning sustainable catering services for the Commission in the Brussels-Capital Region and surrounding areas and, secondly, under Article 268 TFEU for compensation for the losses allegedly suffered by the applicant as a result of that decision.

Operative part of the order

The Court hereby orders:

1.There is no longer any need to rule on the action.

2.The European Commission shall bear its own costs and pay half of the costs incurred by ML.

3.ML shall bear half of its costs.
