By its action under Article 263 TFEU, the applicant seeks the annulment of the decisions of the European Commission of 19 July and 7 August 2024, adopted in Case M.10962 – Kingspan Group (Art. 14(1) proceedings) implementing Article 14(1) of Council Regulation (EC) No 139/2004 of 20 January 2004 on the control of concentrations between undertakings (the EC Merger Regulation) (OJ 2004 L 24, p. 1), and by which the Commission refused its requests for disclosure of several documents in the file in Case M.9938 – Kingspan Group/Trimo.
The action is dismissed as inadmissible.
Kingspan Group plc shall, in addition to bearing its own costs, pay those incurred by the European Commission.
