The applicant claims that the Court should:

annul the decision of the Office for the Administration and Payment of Individual Entitlements of 18 December 2023 establishing the applicant’s pension rights, inasmuch as that decision is based on her normal retirement age of 63 and an annual rate of accrual of pension rights of 1.9 % for the period when she was an official;

order the European Commission to pay the costs and to pay the applicant compensation, the amount of which is to be fixed by the General Court ex aequo et bono.

Pleas in law and main arguments

In support of the action against the decision rejecting the request that Articles 21, 22 and 28 of Annex XIII to the Staff Regulations of Officials of the European Union be applied in order to determine her retirement age and the rate of accrual of her pension rights, the applicant relies on one main plea in law and one plea in the alternative; these are identical or similar to those relied on in Case T-131/24, CR v Commission.
