Directive 2008/115/EC of the European Parliament and of the Council of 16 December 2008, on common standards and procedures in Member States for returning illegally staying third-country nationals, read in conjunction with the Charter of Fundamental Rights of the European Union, must be interpreted as meaning that it does not apply to a decision by which the authorities of a Member State refuse to grant a third-country national staying illegally on its territory a ‘right to stay for compassionate, humanitarian or other reasons’ within the meaning of Article 6(4) of that directive.
