Must Article 51(1) of Regulation (EC) No 883/2004 (1) of the European Parliament and of the Council of 29 April 2004 on the coordination of social security systems be interpreted as applying to an old-age pension the decision on which was adopted by the competent institution of a Member State,

1.only on condition that a ‘special scheme for employed or self-employed persons’ is established under the legislation of that Member State,

1a.and, if so, what characterises such a ‘special scheme’ (for example, the fact that it is administered by a separate institution, it is financed separately, or it is intended only for a particular group of employed or self-employed persons),

2.also where the legislation of that Member State does not provide for such a ‘special scheme’, but merely allows a particular group of persons who have completed periods of insurance solely in the context of a specific activity (for example, miners working in deep mines) to acquire the right, on the basis of such periods, to an old-age pension under more advantageous conditions than other persons who are otherwise employed or self-employed?
