The Court is asked to:
—declare that, by failing to adopt the laws, regulations and administrative provisions necessary to comply with Directive 2008/103/EC (1) of the European Parliament and of the Council of 19 November 2008 amending Directive 2006/66/EC on batteries and accumulators and waste batteries and accumulators as regards placing batteries and accumulators on the market, or in any event by failing to inform the Commission of those measures, the Hellenic Republic has failed to fulfil its obligations under Article 2 of that directive;
—order the Hellenic Republic to pay the costs.
The time-limit for transposing Directive 2008/103/EC into domestic law expired on 5 January 2009.
