The applicant claims that the Court should:
—annul the (implied) decision of the Commission of 17 October 2018 rejecting, under Regulation (EC) 1049/2001, (1) the applicant’s confirmatory application for access to documents relating to the Agreement between the European Community and the United Mexican States on the mutual recognition and protection of designations for spirit drinks; (2)
—order the Commission to pay the costs.
In support of the action, the applicant relies on a single plea in law, alleging that the Commission violated Article 8 (3) of Regulation 1049/2001 by failing to decide within the prescribed time limit.
