1.Dismisses the appeal;

2.Orders Mr Chris van der Aat and the other officials and EU staff whose names are listed in the annex to the judgment to bear their own costs and those incurred by the Commission in the present proceedings;

3.Orders the Council of the European Union to bear its own costs in the present proceedings.
