By its action based on Article 263 TFEU, the French Republic seeks annulment of Commission Implementing Decision (EU) 2021/988 of 16 June 2021 excluding from European Union financing certain expenditure incurred by the Member States under the European Agricultural Guarantee Fund (EAGF) and under the European Agricultural Fund for Rural Development (EAFRD) (OJ 2021 L 218, p. 9), in so far as it excluded from EAGF financing the sum of EUR 45 869 990,19, corresponding to expenditure incurred under a voluntary coupled support measure for the production of fodder legumes, relating to the claim year 2017.
Operative part of the judgment
The Court:
1.Dismisses the action;
2.Orders the French Republic to pay the costs.
