Annulment of the decision of the Committee of the Regions rejecting the applicant’s request, under Article 90(1) of the Staff Regulations, seeking compensation for material and non-material damage allegedly suffered in the context of an administrative and disciplinary procedure.

Form of order sought

Annul Decision of the Committee of the Regions No 352/2010 of 12 November 2010 rejecting the applicant’s request, submitted on 14 July 2010 under Article 90(1) of the Staff Regulations, seeking compensation for material and non-material damage suffered in the context of an administrative and disciplinary procedure;

so far as is necessary, annul the express decision of the Committee of the Regions of 31 May 2011 rejecting the complaint which the applicant submitted under Article 90(2) of the Staff Regulations on 10 February 2011;

order the Committee of the Regions to pay the applicant a sum of EUR 15 000 by way of compensation for the non-material damage suffered as a result of the excessive length of the administrative and disciplinary procedures concerning the applicant;

order the Committee of the Regions to pay the applicant a sum of EUR 15 000 by way of compensation for the non-material damage suffered as a result of errors and negligence on the part of the Committee of the Regions in conducting various administrative and disciplinary procedures;

order the Committee of the Regions to pay the applicant a sum of EUR 41 888,68 by way of compensation for the material damage suffered as a result of the applicant’s involuntary early retirement;

order the Committee of the Regions to pay late payment interest on the above amounts at the European Central Bank rates, plus 2 percentage points;

order the Committee of the Regions to bear the costs.
