(Amicable settlement on the initiative of the Tribunal – Removal from the register)

Application: brought under Articles 236 EC and 152 EA, in which Mr Lohiniva seeks annulment of the decision of the Commission appointing authority of 30 May 2006 rejecting his complaint against the Commission’s decision refusing to recognise his right, from the time of his reassignment to Brussels following a period of service in Finland, to continue to transfer 35% of his net monthly salary to that country, in accordance with Article 17 of Annex XIII to the Staff Regulations.

Held: Case F‑98/06 Lohiniva v Commission is removed from the register of the Tribunal. The Commission is to pay the applicant the sum of EUR 5 000 in final settlement of the case, including his costs. The Commission is to bear its own costs.
