The applicant claims that the Court should:
—annul Commission Implementing Regulation (EU) 2023/2660 (1) of 28 November 2023 renewing the approval of the active substance glyphosate in accordance with Regulation (EC) No 1107/2009 of the European Parliament and of the Council and amending Commission Implementing Regulation (EU) No 540/2011.
Pleas in law and main arguments
In support of the action, the applicant relies on four pleas in law.
1.First plea in law, alleging infringement of Regulation No 1107/2009. (2) In the first place, the applicant states that the analysis methodology applied by the European Food Safety Authority (EFSA) and the European Commission for the adoption of Regulation 2023/2660 infringes Regulation No 1107/2009 as interpreted in the judgment of 2 October 2019, Blaise and Others (C-616/17, EU:C:2019:800). In the second place, the applicant claims that the contested implementing regulation infringes Article 4 of Regulation No 1107/2009, on the ground that it does not meet the approval criteria.
2.Second plea in law, alleging failure to ensure a high level of protection of both human and animal health and the environment as provided for by the Treaty on the Functioning of the European Union, the Charter of Fundamental Rights of the European Union and Regulation No 1107/2009.
3.Third plea in law, alleging failure to observe the precautionary principle.
4.Fourth plea in law, alleging breach of the right to enjoy a clean environment.
