ORDER OF THE PRESIDENT OF THE FIRST CHAMBER OF THE CIVIL SERVICE TRIBUNAL 16 September 2010

(Amicable settlement on the initiative of the Tribunal — Removal from the register)

Application:brought under Articles 236 EC and 152 EA, in which Mr Ernotte seeks, principally, an order that the Commission pay him compensation for the material and non-material loss suffered as a result of the unreasonable period in which it handled the procedure for recognition of the accidental nature and occupational origin of the infarct which he suffered on 28 August 2002.

Held: Case F-90/09 Ernotte v Commission is removed from the register of the Tribunal. The Commission is to pay the applicant the fixed sum of EUR 10 000, which includes his lawyer’s fees.
