The applicant claims that the Court should:

declare that, by having failed to ensure that the national measures transposing the directive into national law covered all the types of organisations competent to make provision for and/or propose professional regulations (that is, the measures of professional associations and organisations and initiatives of parliaments at national level, including parliamentary amendments), the Hellenic Republic has failed to fulfil its obligations under Article 2(1) of Directive (EU) 2018/958 (1) and that, therefore, none of the substantive provisions of the directive may be applied to the rules in question;

declare that, by having failed to guarantee any kind of systematic or regular monitoring of the proportionality of any new or amended provision restricting access to regulated professions or the pursuit thereof following its adoption, the Hellenic Republic has failed to fulfil its obligations under Article 4(6) of Directive (EU) 2018/958;

order the Hellenic Republic to pay the costs.

Pleas in law and main arguments

The Commission seeks a declaration that the directive in question has been infringed, in so far as:

no provision has been made for a procedure for monitoring the proportionality of restrictions adopted on the basis of a legislative proposal or parliamentary amendment, or of restrictions adopted by professional organisations;

no provision has been made for a periodic, ongoing test of the proportionality of existing restrictions.
